Terms and Conditions

Rates: Packages are valid for a limited time only and are subject to change from time to time. A normal session will be 60 minutes long.

Payments: A 50% non-refundable deposit is required to secure your date. This fee secures your date, time and services of the Photographer and is non refundable or transferable in the event of cancellation, it being the agreed loss suffered by the Photographer due to cancellation. The remaining balance is due on the date of your session. Only EFT or Cash payments will be accepted. Please send proof of payment. No photos will be released without full payment.

Please be on time for your photo session, let me know if you are running late. However, please be aware that your slot will start at the scheduled time and not at the time of arrival, which will result in less time for your session and possible less final images. If you are 30 minutes late your session will be cancelled and the Client will forfeit the full session fee and will have to reschedule the session at an additional cost, when there is a suitable opening available. Keep in mind that there may be other responsibilities after your session.

Travelling Expenses: Travelling expenses and toll-gate cost will be quoted separately for sessions outside Potchefstroom.

Accommodation: The following applies to all Wedding Packages. Should the venue of the function be more than 100 kilometers (1 hour's drive) from the Photographer's office, suitable accommodation should be for the Photographer and an assistant (if applicable). The accommodation charges are excluded from the quote and are for the Client's account.

Venue: Photoshoot can be done in the comfort of your own home or any other location. Any venue hire should be arranged by the Client, the Photographer will not be held liable for any venue hire fee. The Client will be held responsible for any damages to property they cause during a session.

Photobook Album: Albums will be designed once the Client have submitted their favorite image selections. Once the Client have signed off the album to be printed, the Client agrees that the Photographer will not be held accountable for any errors, a change of mind or be held responsible for images left out by the Client. The Client acknowledges that the Photographer takes no responsibility for any delays/error by the album supplier or courier. The Client agrees that no images will be included that are not created by the Photographer.

Rescheduling/Cancellation: If you have to re-schedule, please do so at least 7 days prior to your session, so there is time to fill your booking slot. If you have an outdoors/weather dependent photo session, the Photographer will contact and advise the Client to re-schedule due to unsuitable weather, should your booking date be flexible. Your session will be moved to the next suitable/available date at no additional cost. The Client may cancel a booking at any time by given written notice to the Photographer, but in doing so shall forfeit their booking fee (deposit). If a booking is cancelled by the Client within 72 hours prior to the session, the Photographer reserves the right to charge the full fee. If a booking is cancelled by the Client within 30 days prior to the session, 80% of the outstanding amount will be due. If a booking is cancelled by the Client within 60 days prior to the session, 50% of the outstanding amount will be due.

Delivery: The Client will receive a private online gallery via whatsapp/email with instruction to download their session. The gallery will be available online for 7 days. The retouching and editing process can take anything from 2 - 8 weeks, depending on the package, the Photographer's schedule and Eskom Load Shedding. The Photographer will choose the best images for editing. The chosen edited images will uploaded on the Client's private gallery as High Resolution Jpeg images. In the event that the Client does not have access to the internet a CD or Disk can be purchased for R30.00. This request must be given to the Photographer 1 week in advance. Any courier fees for any products to be delivered are excluded from the quote and are for the Client's account. RAW images are the property of Zenography Photography, no unedited images will be released.

Complaints: In the event of any complaint relating to The Photographer’s service and/or materials, it is agreed that such complaints must be received in writing within 2 weeks of collection of the products ordered, failing which The Photographer shall be deemed not to be in breach of any of its obligations and it shall be agreed that all materials were received in a satisfactory condition.

Display: The Client hereby permit and allow the Photographer to display any images, and to generally promote the business by means of advertising , publicity material, websites, exhibitions, competitions, magazine articles, and other such media, providing that the images are used lawfully and without damage to the Client. It is specifically agreed that the material may be used on social media forums as is desired, and that the Client may be tagged, or otherwise identified, unless otherwise agreed in writing.

Failure to Perform: If the Photographer is unable to supply her photographic services due to illness, unforeseen circumstances, mechanical breakdown, accident, acts of God, or any other cause beyond her control, the session date may have to be re-scheduled by the Photographer. In the unlikely event that the Photographer is unable to complete the coverage due to unforeseen circumstances, the Photographer reserves the right to appoint another photographer to attend on her behalf, if such photographer is available. If that does not succeed, the Photographer will return any fees paid by Client and will have no further liability with respect to this Agreement, and the Photographer will not be responsible or liable for any other damages beyond the amount of this Agreement. This limitation of liability will also apply in the event that any Image is lost or damaged through equipment malfunction, or otherwise, without the fault of the Photographer.

Archiving Digital Files: While the Photographer may choose to archive the Image(s), it is Client’s responsibility to properly store and archive the Image(s) after receiving the High Resolution Jpeg images through their private online gallery. The Photographer cannot guarantee the availability of any Image(s) beyond the date of first delivery to the Client. The Client is aware that optical, magnetic, electronic, and any other, media for storing digital data are inherently unstable. The Client hereby releases the Photographer and her contractors, and representatives, from any liability for any claims, damages, or costs, arising from any media supplied by the Photographer becoming unusable. Any requests for the Photographer to reproduce images that were already delivered will incur a processing fee.
